Overview

The Land Acquisition and Adoption Policy 2025–2028 explains how Kesgrave Town Council may acquire or adopt land to protect open spaces and support local facilities for the community. It ensures decisions are made transparently, in line with the Local Government Act 1972 and Neighbourhood Plan Policy KE5.

The policy was approved on 2 June 2025 and will be reviewed in June 2028.

Purpose

The purpose of this policy is to guide how the Council acquires or accepts land by agreement or gift for the benefit, improvement, or development of Kesgrave and its residents. Land may be adopted or purchased for recreation, environmental enhancement, community services, or open space protection.

Background

Resident consultation through the Kesgrave Neighbourhood Plan (KNP) highlighted how much people value the town’s open spaces. Policy KE5 designates six specific Local Green Spaces where development is restricted. This policy builds on that approach by defining how the Council may adopt or acquire land to maintain, protect, or improve such areas.

Principles

  • Land may be acquired under Section 124 of the Local Government Act 1972 for the benefit or improvement of the area.
  • The Council may also accept gifts of land under Section 139 of the same Act, where such gifts serve the community.
  • Land may be adopted or purchased if it provides clear community value and is financially sustainable.
  • All acquisitions must follow due diligence, professional valuation, and legal conveyancing procedures.
  • Resident consultation will be undertaken before committing significant funds.

  • Public open space and green areas.
  • Recreational or environmental land.
  • Allotments or cemetery land.
  • Sites for community facilities (e.g., library, offices, community cafés).

Policy Commitment

  • To acquire or adopt land that can be used for recreation and public benefit.
  • To adopt public open spaces from East Suffolk Council or Suffolk County Council to allow direct investment and improvement.
  • To consider financial viability and community support before purchasing any land at development value.
  • To ensure transparency and public consultation throughout any acquisition process.
