Overview

The Resignation and Co-option to Casual Vacancies Policy 2025–2028 explains how Kesgrave Town Council handles councillor resignations and fills vacancies when they occur between ordinary elections. It ensures that all vacancies are managed lawfully under the Local Government Act 1972 and in a fair and transparent way.

Resignation Procedure

Councillors may resign at any time by giving written notice. Under Section 84 of the Local Government Act 1972:

  • A councillor’s resignation must be submitted in writing to the Chair of Council.
  • The resignation takes effect immediately on receipt and cannot be withdrawn.
  • If the Chair of Council wishes to resign, written notice must instead be given to the Town Clerk.

A councillor who has resigned may stand again at the next election or be considered for co-option when Council publicly advertises a vacancy.

Co-option to Casual Vacancies

A vacancy can arise through resignation, death, prolonged absence, or disqualification. If an election is not requested, Council may fill the vacancy by co-option in line with this policy.

  • Co-option may only occur after the statutory notice period has expired and no election has been called.
  • All candidates must meet the same eligibility criteria as elected councillors.
  • Candidates submit a short written CV and may attend a Council meeting to introduce themselves.
  • Appointments are decided by a vote of full Council and confirmed by resolution in open session.
  • Co-opted members serve until the next full election and must then stand for election if they wish to continue.

Vacancy for Chair of Council

If the casual vacancy concerns the Chair of Council, the Clerk will convene a meeting of full Council for the election of a new Chair. This is usually held as soon as practicable.

Transparency and Good Practice

  • Vacancies and co-option opportunities are publicised on the Council’s website and noticeboards.
  • Selection decisions are made openly and recorded in the Council’s minutes.
  • New councillors receive an induction and are expected to follow the Code of Conduct and undertake training.
