How Kesgrave Town Council manages councillor resignations and fills vacant seats
The Resignation and Co-option to Casual Vacancies Policy 2025–2028 explains how Kesgrave Town Council handles councillor resignations and fills vacancies when they occur between ordinary elections. It ensures that all vacancies are managed lawfully under the Local Government Act 1972 and in a fair and transparent way.
Councillors may resign at any time by giving written notice. Under Section 84 of the Local Government Act 1972:
A councillor who has resigned may stand again at the next election or be considered for co-option when Council publicly advertises a vacancy.
A vacancy can arise through resignation, death, prolonged absence, or disqualification. If an election is not requested, Council may fill the vacancy by co-option in line with this policy.
If the casual vacancy concerns the Chair of Council, the Clerk will convene a meeting of full Council for the election of a new Chair. This is usually held as soon as practicable.
